These terms govern your use of Simples. Please read them before using the paid declaration builder.

What Simples does

Simples is software for preparing Portuguese IRS Modelo 3 filing materials. Based on your answers and a prefilled XML file downloaded from Portal das Finanças, Simples helps identify likely annexes, prepare an updated XML file, and guide you through import, validation, review, and submission in Portal das Finanças.

Simples does not submit declarations on your behalf. You remain responsible for reviewing, validating, and submitting any declaration in Portal das Finanças.

No professional advice

Simples is not a certified accountant, law firm, financial adviser, tax representative, or public authority. The product provides software output and general filing assistance, not individual tax, legal, financial, or accounting advice.

If your situation is complex or you are unsure about a filing position, you should consult a certified accountant, tax adviser, lawyer, or Autoridade Tributária.

Your responsibilities

• You must provide accurate, complete, and current information.
• You must use the correct tax year and the correct prefilled declaration file.
• You must review all values in Portal das Finanças before submission.
• You must run the official validation and simulation checks available in Portal das Finanças.
• You must decide whether the generated output is suitable for your situation.
• You must not upload files or enter data that you are not allowed to process.

Supported scope

Simples supports only the filing scenarios shown in the product flow. If the product marks a case as unsupported, uncertain, or requiring review, you should not rely on Simples as a complete filing solution for that case.

Tax law, XSD schemas, Portal das Finanças behavior, and official validation rules may change. We work to keep Simples current, but we cannot guarantee that every generated file will be accepted by Portal das Finanças in every situation.

Paid access

Paid access unlocks the declaration-builder flow for the tax year and product scope shown at checkout. Access is delivered digitally and starts immediately after payment confirmation.

You are responsible for keeping your access link secure. Anyone with access to your email or access link may be able to restore paid access in that browser.

Prices, payment, and refunds

Prices are shown before checkout. Stripe processes payments. Simples does not receive full card numbers.

If you paid but cannot access the product, contact us and we will help restore access or issue a refund where appropriate. Nothing in these terms limits any mandatory consumer rights that apply to you.

Right of withdrawal

If consumer withdrawal rights apply in your country, they remain available as required by law. Because Simples provides digital access immediately after payment, the way withdrawal rights apply may depend on the consent and acknowledgement collected at checkout and on whether the digital service has already been fully performed.

Availability and changes

We aim to keep Simples available during the filing season, but we may suspend, update, or change the service for maintenance, security, legal, provider, or product reasons. We may also stop supporting scenarios that become unreliable or legally unclear.

Acceptable use

You must not misuse Simples, interfere with the service, attempt to bypass payment, reverse engineer non-public parts of the service, overload the infrastructure, use the service for unlawful purposes, or submit malicious files.

Intellectual property

Simples and its website, software, design, text, brand assets, and documentation are owned by Cozmo Technologies, Inc. or its licensors. We grant you a limited, non-exclusive, non-transferable right to use Simples for your own filing preparation, subject to these terms.

You retain responsibility for the data you enter and the files you upload. You grant us the limited rights necessary to provide the service, process payment and support requests, maintain security, and improve the product as described in the Privacy Policy.

Third-party services

Simples depends on third-party services including Portal das Finanças, Stripe, Cloudflare, Resend, and PostHog. Their services, terms, privacy policies, uptime, and behavior are outside our control.

Liability

To the fullest extent permitted by law, Simples is provided without warranties that it will be uninterrupted, error-free, accepted by Portal das Finanças, or suitable for every tax situation.

We do not exclude or limit liability where the law does not allow it, including for intentional misconduct, fraud, or mandatory consumer rights. Otherwise, our liability is limited to the amount you paid for Simples for the relevant tax year.

Termination

We may suspend or terminate access if you breach these terms, misuse the product, create security risk, or if continuing access would be unlawful or harmful to the service. You may stop using Simples at any time.

Governing law and mandatory rights

These terms are governed by the laws of Delaware, United States, unless mandatory consumer-protection law in your country gives you additional rights or requires another forum. Nothing in these terms removes mandatory rights you have as a consumer in your country of residence.

Changes to these terms

We may update these terms as the product, filing process, providers, or law changes. The date above shows the latest version. Material changes apply prospectively unless required by law or necessary for security or compliance.
